The issues for the long-delayed Tupac biopic continue.
Production company Emmett Furla Oasis has sued Morgan Creek Productions for breaching the contract for the Tupac biopic, reports The Hollywood Reporter.
Emmett Furla Oasis is seeking $10 million in damages, claiming Morgan Creek selected a lead actor, set a budget and production schedule without its consent.
The company says they signed an agreement with Morgan Creek to producing the film in September 2013, with terms including a production budget not above $30 million, mutual approval on decisions such as the production schedule, the director, and the actor who would portray Tupac.
Emmett Furla Oasis says Morgan Creek made these decisions without them.
"Plaintiffs' involvement with the project caused the resurrection of the Picture," the complaint states. "Specifically, because of Plaintiffs, the Picture was effectively reintroduced into the marketplace after a long period of inactivity, and Plaintiffs immediately advanced the development and production of the picture."
Emmett and Furla claims to have arranged a distribution deal with Open Road Films, which was rejected by Morgan Creek. But then, Morgan Creek returned to Open Road and inked a new distribution deal in violation of the producers' agreement to mutually approve distribution agreements.
The real problem arose with the release of the N.W.A biopic, Straight Outta Compton, which includes Tupac. Emmett Furla says Morgan Creek approached them demanding a budget of more than $34 million, asking they pay for half... but they refused. In doing so, Morgan Creek claims Emmett Furla broke the contract.
"Their responsibility was to come in with half the budget," Morgan Creek Executive Vice President of marketing and publicity Greg Mielcarz says. "That didn't happen. End of story."
Morgan Creek says that the role of Tupac has not been cast.
The film is scheduled to go into production in December.
